1. Introduction
This Privacy Policy describes how trixie ("we", "our", or "us") collects, uses, and shares information when you use our mobile application (the "App"). We are committed to protecting your privacy and handling your data transparently.
By using the App, you agree to the collection and use of information in accordance with this policy.
2. Information We Collect
We collect the following types of information to provide and improve our service:
- Account Information: When you sign in using Apple, we collect the name and email address associated with your Apple ID to create and manage your account.
- Voice Data (Biometric Information): We collect audio recordings of your voice ("Voice Samples"). These samples are used exclusively to create a synthetic, digital clone of your voice ("Voice Clone"), which is the core function of the App. Voice data may be considered biometric information in some jurisdictions and is treated with enhanced security measures, including encryption at rest. We obtain your explicit consent for the collection and processing of biometric data during onboarding, through a separate consent mechanism.
- App Logs: We collect standard technical logs, which may include crash reports, device type, and performance data, for debugging and monitoring purposes to ensure the App is functioning correctly.
3. Legal Basis for Processing
We process your personal data based on the following legal grounds:
- Contractual Performance: To provide the voice cloning services you have requested through your use of the App.
- Legitimate Interest: To maintain and improve our service, ensure security, and respond to support requests.
- Consent: Explicit consent is required for processing sensitive biometric voice data.
4. How We Use Your Information
We are committed to using your data solely to provide and maintain your account and the services you request. Specifically, we use your information to:
- Authenticate Your Account: Using the name and email provided by Apple Sign-In.
- Provide Core Services: To process your Voice Samples, create your Voice Clone, and generate audiobooks at your request. We do not use your voice data for any other purpose, such as training our AI models.
- Maintain the App: To use app logs for debugging and ensuring the service is running reliably.
- Respond to You: To answer your support requests and inquiries sent to our contact email.
5. Sharing and Disclosure of Information
We do not sell or share your personal data for cross-context behavioral advertising. We share your information only in the following limited circumstances:
- With Our Core Technology Partner (ElevenLabs): To provide our voice cloning service, we use the Application Programming Interface (API) of ElevenLabs Inc. ("ElevenLabs"). ElevenLabs acts as our data processor, handling your data only under our instructions. Your Voice Samples and Voice Clone are processed and stored on ElevenLabs' secure platform to enable the core functionality of the App. We have a Data Processing Agreement (DPA) in place with ElevenLabs, which obligates them to provide equivalent levels of data protection. ElevenLabs retains data only as long as necessary to provide the requested service and is contractually required to delete it when instructed by us.
- For Legal Reasons: We may share information if we believe disclosure is required by law, to protect the rights and safety of our users or others, or to respond to a legal request.
- In a Business Transfer: If we are involved in a merger or sale of assets, your information may be transferred as a part of that transaction.
6. Data Retention and Deletion
We store your personal data only for as long as you have an active account with us. This includes your account information, raw Voice Samples, your Voice Clone, and any generated audiobooks. Generated audiobooks remain available to you while your account is active, but you may delete them at any time.
An account is considered inactive if you have not accessed the App for 24 consecutive months. We will provide 30 days' notice before deleting inactive accounts.
If you choose to delete your account using the in-app feature or by contacting us, all of your personal data will be permanently and irreversibly deleted from our systems within 30 days. We will also instruct our partners, including ElevenLabs, to delete all of your associated voice data within the same timeframe.
7. Data Security and Breach Notification
We implement appropriate technical and organizational measures to protect your data, including:
- Encryption for data in transit (TLS/SSL) and at rest
- Secure storage protocols for voice data
- Access controls and authentication measures
- Regular security assessments and penetration testing
However, no method of electronic transmission or storage is 100% secure, and we cannot guarantee its absolute security.
In the event of a data breach that may affect your personal information, we will notify you within 72 hours of becoming aware of the breach, in accordance with applicable data protection laws.
8. Children's Privacy
Our service is intended for use by adults (parents and guardians) to create audio content for their children and families.
To use the App, you must be at least 18 years of age or the age of legal majority in your jurisdiction. You must be an adult to create an account and to provide the voice recordings for cloning. Only adult voices may be cloned, and children's voices must not be uploaded. We do not knowingly collect personal information from children under the age of 13. If you believe we have inadvertently collected such information, please contact us immediately at hello@wearetrixie.com so we can take steps to delete it.
9. Your Privacy Rights
Depending on your location (such as the UK, EEA, or California), you have certain rights regarding your personal data, including:
- The right to access the data we hold about you.
- The right to correct any inaccurate data.
- The right to delete your data.
- The right to object to the processing of your data.
- The right to restrict processing.
- The right to data portability (where technically feasible).
You can exercise your right to deletion at any time through the in-app account deletion feature. For other requests, please contact us at hello@wearetrixie.com. We will respond to your request within 30 days.
California Residents (CCPA/CPRA): We do not sell or share your personal information as defined by the California Consumer Privacy Act. You have the right to request access to your personal information, request deletion, and request correction of inaccurate information. 10. International Data Transfers
Your information, including personal data, may be transferred to—and maintained on—computers located outside of your state, province, or country where data protection laws may differ. Our technology partner, ElevenLabs, is based in the United States.
For transfers to countries without adequate data protection laws, we implement appropriate safeguards such as:
- Standard Contractual Clauses approved by relevant data protection authorities
- Ensuring our partners maintain equivalent levels of data protection
- Regular assessments of transfer mechanisms
By using our App, you consent to this transfer subject to these safeguards.
11. Changes to This Policy
We may update this Privacy Policy from time to time. We will notify you of any material changes by:
- Posting the new policy within the App
- Sending an email notification to your registered email address
- Providing at least 30 days' notice before material changes take effect
Your continued use of the App after any changes indicates your acceptance of the new policy. The version number and effective date will be updated to reflect any changes.
